Guiding You Through Divorce and Toward a Better Next Chapter

Steady Legal Support Through Every Stage of Divorce

Divorce is one of the hardest things a person goes through, and the legal side often arrives exactly when you have the least energy for it. Deadlines, paperwork, and court procedures pile up at a moment when emotions are already running high—and the decisions you make now will affect your finances and your family for years.

You don’t have to carry it alone. With experienced representation, you can move through the process with a clear head and a clear plan.

We help spouses understand their rights, protect what matters most, and avoid the costly mistakes that come from going it alone—offering steady, honest guidance from the first conversation to the final decree.

Handling Your Divorce With Care and Clarity

Every marriage—and every divorce—is different. Depending on your situation, your case may involve:

Property Division

Texas is a community property state, which means most assets and debts acquired during the marriage are divided between spouses. We work to ensure a fair division of your home, accounts, retirement, and other property, and to protect what's rightfully separate.

Child Custody & Support

When children are involved, we help you secure a possession schedule that protects your relationship with your kids, along with a support order grounded in the law.

Negotiation

When you and your spouse can't agree, you need an attorney ready to advocate for you. We negotiate aggressively where it helps and stand ready to try your case in court when a fair settlement isn't possible. When we do reach an agreement, we ensure the orders and transfer documents are correct so that you receive the benefit of your bargain—keeping costs down, avoiding unnecessary conflict, and making sure the final order protects you and holds up over time.

Complex Matters

When your situation requires, we have the experience to harness outside experts to value and divide business interests and separate property claims that require extra care. We have the experience to handle complex financial issues and protect your long-term stability.

Common Divorce Questions

How long does a divorce take in Texas?

In north Texas, a typical divorce will last 6-9 months from the date of filing but depending on specifics could go as long as 2 years.

Texas allows no-fault divorce, meaning you can divorce on the grounds of “insupportability” without proving wrongdoing. However, fault grounds like adultery or cruelty can still be raised and may affect how property is divided.

Texas is a community property state, so assets and debts acquired during the marriage are generally subject to division in a “just and right” manner. Note that tax advantages, liquidity, and other factors can influence the relative subjective value of assets.

If your case involves a business, significant property, or compensation more complicated than a paycheck, the questions shift to valuation, separate-property tracing, and what can practically be divided at all. See Complex Property Division.

Not always. Many divorces settle through negotiation or mediation without a trial. If you and your spouse can reach an agreement, we can finalize your divorce without a courtroom fight. If you can’t, we’re fully prepared to represent you at trial.

Some parts of a decree—like custody, possession, and child support—can be modified later if circumstances change substantially. Property division, however, is generally final. We handle post-decree modifications and enforcement when life changes after your divorce. Do NOT plan on making changes in the future. We seek stable, healthy, positive orders for our clients that hopefully will withstand the test of time.

Why Clients Choose David Eaker

David Eaker has practiced family law in North Texas since 1999. Over those 27-plus years in Rockwall and Collin County courts, he’s come to know the local judges and courthouse staff—the kind of familiarity that helps a case move smoothly and predictably.

He also understands these cases personally. As a divorced father who raised his own boys, David knows the fear and exhaustion a divorce brings firsthand. Clients tend to say the same things about working with him: his fees are straightforward, he never leaves you in the dark, and he keeps you steady when the people around you are caught up in the drama.

His approach is simple—resolve what can be settled through negotiation or mediation, fight hard at trial when it’s necessary, and keep your costs reasonable along the way. As David tells every client: you will be okay. Let us help you.
