Texas requires a minimum 60-day waiting period from the day you file before a divorce can be finalized. An uncontested divorce may wrap up shortly after that, while a contested case involving property or custody disputes can take several months to a year, depending on the issues involved.

Texas allows no-fault divorce, meaning you can divorce on the grounds of “insupportability” without proving wrongdoing. However, fault grounds like adultery or cruelty can still be raised and may affect how property is divided or how support is decided.

Texas is a community property state, so assets and debts acquired during the marriage are generally subject to division. Courts divide community property in a way that is “just and right”—which doesn’t always mean a 50/50 split. Separate property you owned before the marriage typically stays yours.
